Visitation Issues

In most jurisdictions, parents share significant access to their children after a divorce if they have both been involved parents during the marriage. The visitation schedule is often tied to a standard possession order and by what is in the best interest of the child.

 

The standard possession order outlines when children will be with one parent or the other. The order is used to ensure that children maintain a relationship with each parent after the divorce.

 

Standard visitation schedules are based on distance. If the ex-spouses live less than 100 miles apart, you will share shorter, more frequent blocks of time with the children. If the parents live more than 100 miles apart, a different standard schedule accounts for travel time and expenses.

 

If you have young children at the time of your divorce, it is likely to have visitation problems at some point in the future. No settlement agreement can address all of the potential circumstances. However, once a visitation schedule is set, you must comply with it unless both you and your ex-spouse agree to changes. It is not a suggestion; it is a court order.
